Calmful Terms of Use

These Terms of Use (“Terms”) form a binding agreement between you and DeLow Dynamics (“DeLow Dynamics,” “we,” “us,” or “our”) governing your use of the Calmful mobile application, website, and related services (collectively, “Calmful”). By downloading, accessing, or using Calmful, you agree to these Terms and the Calmful Privacy Policy.

1. Eligibility

You must be at least 13 years old to use Calmful. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you.

2. Wellness Service; Not Medical Care

Calmful supports general mindfulness and wellness. It is not medical, psychological, psychiatric, therapeutic, or emergency care and does not diagnose, treat, cure, or prevent any condition.

Content may not be appropriate for every person or situation. Do not disregard or delay professional advice because of Calmful content. If you believe you may harm yourself or someone else, or you are experiencing an emergency, contact local emergency services or an appropriate crisis service immediately.

3. Accounts and Guest Use

You may use eligible features as a guest or create an account using supported authentication methods. You are responsible for maintaining the security of your account and device and for activity occurring through your account. Information you provide must be accurate and lawful.

If you begin as a guest and later sign in, Calmful will attempt to merge eligible local or anonymous guest information into the signed-in account. Network failures, device resets, app deletion, provider limitations, or conflicts may prevent some guest information from transferring. You should not use Calmful as the sole repository for information you cannot replace.

4. Free Service, Advertising, and Paid Features

Eligible free users may receive locally selected mindfulness content, limited guided-session access, and non-personalized Google AdMob advertising. Features, limits, and available content may change over time.

An active Calmful subscription unlocks the paid features described in the purchase screen, which may include expanded mindfulness generation, guided sessions, audio features, optional SMS eligibility, and removal of in-app ads. Subscriber access depends on successful verification of the Apple entitlement.

5. Monthly and Yearly Subscriptions

  • Calmful offers monthly and yearly auto-renewing subscriptions through Apple’s App Store. Available pricing and any trial or introductory offer are shown by Apple before purchase.
  • Payment is charged to your Apple Account when you confirm the purchase.
  • Your subscription renews automatically unless you cancel through your Apple subscription settings at least 24 hours before the end of the current period, subject to Apple’s then-current rules.
  • Apple handles billing, cancellations, refunds, taxes, and payment disputes under Apple’s terms and policies. Deleting Calmful or your Calmful account does not automatically cancel an Apple subscription.
  • You can use Restore Purchases in Calmful for eligible purchases associated with your Apple Account.
  • If entitlement verification is delayed or unavailable, paid features may remain unavailable until verification succeeds. If a subscription expires, is refunded, is revoked, or cannot be verified, paid access ends and ads may return.

6. Optional Subscriber Text Messages

Eligible paid subscribers may separately opt in to receive recurring Calmful mindfulness text messages. Message frequency is generally one message per day but may vary. Message and data rates may apply. Consent to SMS is not a condition of purchasing a subscription. Reply STOP to cancel or HELP for help, or disable SMS in Calmful Settings. Carrier delivery is not guaranteed. SMS may stop if your subscription is no longer active, your number is invalid, you revoke consent, or delivery is unavailable.

7. Notifications

If you enable app notifications, Calmful may schedule local check-in or mindfulness reminders at the time you select. Your device controls notification permission and delivery. Changes to time zone, device settings, Focus modes, operating-system behavior, or notification permissions may affect delivery.

8. AI-Generated and Audio Content

Some subscriber content may be generated or narrated using third-party artificial intelligence or audio services. Generated content can be incomplete, repetitive, inaccurate, or unsuitable. You are responsible for deciding whether content is appropriate for you. Calmful may use curated or bundled fallback content when generation, network access, or remote content is unavailable.

9. Acceptable Use

You agree not to:

  • Use Calmful unlawfully, fraudulently, or to harm, harass, exploit, or deceive another person.
  • Attempt to bypass subscription, advertising, authentication, usage, security, or SMS-consent controls.
  • Reverse engineer, scrape, interfere with, overload, probe, or gain unauthorized access to Calmful or its providers, except where applicable law expressly permits otherwise.
  • Upload or transmit malicious code, unlawful content, or content that violates another person’s rights.
  • Resell, sublicense, or commercially exploit Calmful content or services without our written permission.

10. Your Content and Feedback

You retain ownership of information you enter into Calmful. You grant us a limited license to host, process, copy, and transmit that information only as needed to operate, secure, and improve Calmful and fulfill your requests. If you provide feedback or suggestions, you allow us to use them without restriction or compensation.

11. Intellectual Property

Calmful, including its software, design, branding, text, audio, graphics, and curated content, is owned by DeLow Dynamics or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use Calmful for your own noncommercial wellness purposes.

12. Third-Party Services

Calmful depends on services supplied by Apple, Google, Firebase, AdMob, Twilio, OpenAI, ElevenLabs, carriers, and other providers. Their terms and policies may apply to your use of their services. We are not responsible for third-party services, content, outages, billing systems, or acts beyond our reasonable control.

13. Changes, Availability, and Termination

We may add, modify, suspend, or discontinue features or content, including free limits and remote sessions, when reasonably necessary to operate or improve Calmful. We may suspend or terminate access for material violations of these Terms, fraud, abuse, legal requirements, or security risks. You may stop using Calmful at any time and may initiate account deletion in Settings.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALMFUL IS PROVIDED “AS IS” AND “AS AVAILABLE.” DELOW DYNAMICS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT CALMFUL WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY MESSAGE, NOTIFICATION, SESSION, PURCHASE VERIFICATION, OR SMS WILL ARRIVE AT A PARTICULAR TIME.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELOW DYNAMICS AND ITS OWNERS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, GOODWILL, OR OPPORTUNITIES, ARISING FROM CALMFUL. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO CALMFUL WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR CALMFUL DURING THE 12 MONTHS BEFORE THE CLAIM OR USD $50. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where the consumer laws of your location require otherwise. Courts with lawful jurisdiction may hear disputes that cannot be resolved informally.

17. Changes to These Terms

We may update these Terms as Calmful changes. We will post the revised Terms here and update the date above. Material changes may receive additional notice where required. Continuing to use Calmful after revised Terms take effect means you accept them.
